According to Scott, requiring developers to plan for a product's end-of-life cycle during initial construction would ensure that purchased digital goods remain accessible to consumers long after active commercial support terminates.
In a conversation first reported by Ars Technica during an interview with Senior Gaming Editor Kyle Orland, Scott stated that his frustration with server-dependent digital shutdowns dates back more than fifteen years. He explained that he spent years waiting for established legal experts or veteran industry figures to challenge the practice publicly before deciding to organize the campaign himself. Scott characterized taking on the leadership role as drawing the short straw, noting that an organized consumer advocacy effort was necessary because no other entities were taking action to address the permanent loss of software access.
During the discussion, Scott highlighted the stark contrast between digital media licensing and traditional consumer protection standards across other commercial sectors. He argued that selling software that can be unilaterally rendered non-functional at an unspecified date without clear advance disclosure would violate consumer norms in almost any other market. Scott drew parallels to commercial warranties and insurance policies, observing that legal frameworks in other industries explicitly prohibit vendors from withholding critical expiration timelines or abruptly canceling services without predefined contractual terms.
Addressing common industry concerns regarding the financial burden of supporting defunct titles, Scott argued that engineering end-of-life solutions is technically straightforward and cost-effective if planned from the outset. He noted that when software architects establish server sunset protocols during the initial design phase of a project, the additional expenditure remains negligible. Rather than requiring publishers to fund indefinite server upkeep or subsidize ongoing operational overhead, the campaign advocates for structural design shifts that allow games to transition to private hosting or standalone offline modes.
To illustrate the technical viability of this transition, Scott highlighted the internal workflows already utilized by modern development teams. Most online-dependent titles rely on local server environments during production so engineering work can continue during cloud service disruptions, such as outages on Amazon Web Services or software incompatibility issues. Scott emphasized that because studios routinely build and maintain these operational local server instances for internal testing purposes, developers already possess half of the technical components necessary to release uncoupled, standalone server executables to the public when official support ends.
Moving to the political and regulatory landscape, Scott shared his experience engaging with European Union governing bodies. The initiative sought to collect one million signatures on an official petition to force the European Commission to clarify whether existing consumer protection statutes cover server-rendered software destruction. Scott expressed disappointment over the initial administrative reaction, stating that executive officials avoided making a binding structural ruling and instead delegated the matter to individual national court systems, despite the commission's designated role in unifying cross-border commerce regulations across member states.
Despite those initial regulatory hurdles, Scott noted that the broad visibility generated by the petition successfully attracted formal support from members of the European Parliament. The movement is now targeting inclusion in the European Union’s upcoming Digital Fairness Act, a comprehensive regulatory framework intended to address dark patterns, unfair commercial practices, and digital rights across online markets.
