The U.S. Environmental Protection Agency is preparing to eliminate federal regulations that require public notification and comment periods before states grant air-pollution permits to industrial facilities, according to reporting from Capital B, published via Hacker News. The proposed rule modification directly impacts the rapid national buildout of artificial intelligence data centers as well as the dedicated power plants constructed to supply their expanding electrical requirements.

In tandem with the notification changes, the EPA introduced a second regulatory proposal last month that would permit developers to initiate data center construction prior to obtaining final permit approvals. Taken together, the federal actions aim to streamline infrastructure deployment as the technology sector races to expand computational capacity for AI workloads. EPA Administrator Lee Zeldin previously identified transforming the United States into the global capital for artificial intelligence as the agency's primary mandate, shifting focus at the 56-year-old regulator, which was established in 1970 to protect public health and the environment.

The federal policy shifts arrive amid widespread public resistance to AI infrastructure expansion. Survey data indicates that seven out of ten Americans oppose the construction of AI data centers within or adjacent to their local communities. Opponents argue that reducing public oversight will limit opportunities for residents to inspect projects, ask questions, or challenge permitting decisions before groundbreaking occurs. Nearly 200 advocacy organizations and more than a dozen states governed by both Democrats and Republicans have formally voiced opposition to the federal changes.

In a public statement, the EPA defended the policy by stating that the proposed framework would provide state and municipal regulatory agencies with the authority to determine whether, when, and for how long public participation opportunities should be offered. The agency added that the adjustments are intended to responsibly accelerate permitting procedures to reinforce domestic economic growth and energy production. The federal government anticipates finalizing the regulatory proposal within the coming year.

The rapid proliferation of data centers has been notably concentrated in the rural American South, where local communities often feature high proportions of Black residents. In South Carolina, environmental organizer Paul Black is opposing a proposed data center development spanning an area equivalent to 1,200 football fields in a municipality that is 40 percent Black. The developer previously attempted to construct a similar facility in a predominantly white county in Georgia before retreating due to local resistance. Black warned that the regulatory revisions eliminate essential civic protections, noting that corporate developers are attempting to move swiftly into rural regions with minimal public disclosure.

Local government practices have also limited public visibility into tech infrastructure expansions. Municipal authorities regularly sign non-disclosure agreements with technology corporations to keep project details confidential, at times disregarding legal orders to prevent the release of operational data. In Louisiana, where the country's largest data center facility is currently under development, Public Service Commissioner Davante Lewis was the sole board member to vote in favor of disclosing electricity consumption figures associated with the project.

The infrastructure demands of massive facilities are straining regional power grids and driving local energy costs higher. Data center operations frequently rely on new gas-fired turbines and power generation facilities, which discharge fine particulate matter, smog-forming nitrogen oxides, and toxic air pollutants like formaldehyde. Brandon Jones-Cobb, a senior attorney at the Center for Biological Diversity, criticized the EPA's direction, emphasizing that silencing front-line communities exacerbates health risks for residents already bearing the highest exposure to industrial emissions. Meanwhile, utility providers routinely pass the capital expenses of grid upgrades onto consumers, disproportionately affecting lower-income and Black households through elevated electric bills and potential utility shutoffs.

State-level regulators are simultaneously reducing oversight to accommodate the sector's power demands. Last month, South Carolina enacted a decision permitting power plants built for data centers to proceed without review or approval from the state's public utility regulatory commission. Simultaneously, rapid industrial development is disrupting local real estate markets. In the vicinity of Meta's construction site for a massive data center project, local officials reported that median housing and rental rates surged 80 percent in a single year, resulting in the eviction of trailer park residents to make room for incoming construction staff.
