Kalshi Challenges Nevada Regulators Over Proposed $120,000 Daily Geofencing Fines

Prediction market operator Kalshi has formally challenged Nevada gaming regulators after state officials requested daily financial penalties against the company totaling $120,000 per day. The regulatory enforcement action stems from allegations that the platform failed to properly implement location-blocking technology within state borders.

The dispute escalates an ongoing legal battle between the financial technology company and state enforcement authorities over regulatory compliance. According to court filings first reported by Reuters and published by Yahoo Finance, state officials sought the daily fines after alleging that users inside Nevada could still interact with Kalshi's trading system.

Documents submitted to the court revealed that investigators from the state gaming board managed to execute nine separate trades using Kalshi's mobile application. The transactions were completed while connected to local cellular networks inside Nevada, occurring just one day after a court-ordered deadline mandating a complete geofencing solution.

In a statement issued Saturday, Kalshi disputed the regulatory board's claims, explaining that it had taken explicit steps requested by the state to ensure compliance. The company noted that it retained GeoComply, a third-party location-verification vendor licensed by Nevada's own gaming authority, and maintained ongoing communication with state officials throughout the integration.

Attorneys representing Kalshi argued that the test trades involved improper conduct by state enforcement personnel. The legal team asserted that Nevada investigators provided false residential information to create accounts on the platform, which they argued constitutes a violation of federal law.

Furthermore, Kalshi's legal representatives stated that at least one state investigator deliberately evaded the platform's automated blocking protocols to place transactions. The startup contended that these actions do not demonstrate a technical failure of its geofencing system, but rather an intentional effort to circumvent its security measures.

The enforcement action follows a ruling from April, when a Nevada state judge granted a preliminary injunction prohibiting Kalshi from offering prediction contracts within the jurisdiction without first securing a local gaming license. Nevada court representatives did not immediately respond to requests for comment outside regular business hours on Saturday.
