The U.S. Environmental Protection Agency is moving forward with a regulatory proposal that would eliminate federal mandates requiring public notification and community feedback on air pollution permits for minor industrial sources, a policy shift that could streamline data center construction across the country, as first reported by The Verge.

The proposed modifications alter the New Source Review framework, an air quality permitting structure established in the 1970s that governs emissions across various industrial facilities, including paper mills, power plants, and technology infrastructure. Under the existing federal standards, developers applying for air permits must publicly disclose their plans and provide local residents an opportunity to submit formal comments.

First announced in July, the EPA's plan would remove federal public participation requirements for minor pollution sources and leave notification rules to the discretion of state and local air agencies. "The state and local authorities closest to the issues and the public should be making the decisions on the permitting process as much as possible, not Washington," EPA Administrator Lee Zeldin said in a statement at the time of the announcement, adding that the agency was removing "unnecessary and burdensome red tape."

Environmental legal advocacy groups contend that facilities categorized under "minor" source permits can still generate significant environmental impacts. Keri Powell, senior attorney and air program leader at the Southern Environmental Law Center (SELC), warned that the proposal would allow industrial operators to secure approvals without public input. "You can see why that would be so interesting to an administration that wants to rush through the construction of data centers," Powell said, adding that under the proposed framework, facilities could "issue the permits in secret behind closed doors. Nobody knows what’s happening until the bulldozers are out there."

Permitting for minor pollution sources has emerged as a major point of friction between community groups and tech infrastructure developers expanding power-intensive facilities for artificial intelligence. In 2025, Elon Musk's xAI submitted a minor source air permit application for its Colossus 1 facility in Tennessee, which the startup described as the world's most powerful AI training system. The application triggered a public hearing and thousands of written comments to local health officials. Later that year, the SELC and the NAACP threatened legal action against xAI over the installation of unpermitted gas turbines at the site.

Nearly 200 environmental and public health organizations recently submitted comments urging the EPA to abandon the regulatory change. Byron Gary, senior attorney at the Kentucky Resources Council, stated in a press release that the shift "could deprive the agencies making decisions about these [pollution] sources the necessary lived experience data of those communities," making it difficult for regulators to assess cumulative environmental impacts.

The official public comment window on the EPA's proposed rule change closed last week. Agency spokesperson Carolyn Holran told The Verge in an email that regulators are currently reviewing more than 4,900 submitted comments before determining whether to finalize the rule change.
